Waiver and Release of Liability // Terms & Conditions

THIS AGREEMENT is entered into by and between Funtime 4 Pups and (“Owner”) as of Dog (below) participating in Park Playtime Trips. Dog or Dogs plural apply to this binding agreement regardless or plural/singular grammar below, to cover all dogs Owner has enrolled in services of any kind from Funtime 4 Pups.

By requesting and purchasing services from Funtime 4 Pups, Owner hereby certifies that Owner has read and understands this Waiver and Release of Liability and the regulations set forth above. Owner agrees to be bound by its terms and conditions.

By enrolling the named dog(s) below, I represent that I am the legal owner of the named dog(s) and I assume all risks, dangers and responsibilities for injuries to the named dog(s). Owner understands and agrees that the Owner is solely responsible for any harm to Owner’s dog while Owner’s dog is/are attending Park Playtime Trips.
Owner understands and agrees that during normal dog play, Owner’s dog may sustain injuries. All dog play is monitored by Funtime 4 Pups Staff to avoid injury, but scratches, punctures, torn ligaments and other injuries may occur despite the best supervision. Owner understands that Owner is solely responsible for any harm, including to any other pet(s), to the staff members, and to public human/canine bystanders during Park Playtime Trips, or to any other property of Funtime 4 Pups, caused by Owners dog(s). Owner also agrees that Funtime 4 Pups shall not be responsible or liable for any lost or damaged personal property belonging either to Owner or Owner’s pet.
All dogs must be able to interact safely with other dogs and humans in order to attend Park Playtime Trips. No dog may be admitted showing any signs of any type of aggression, harm, or danger. Determinations for these criteria shall be made at the sole discretion of Funtime 4 Pups Staff and may be revised or revisited at anytime. The owner further understands and agrees that in admitting Owner’s dog to Park Playtime Trips the Owner is representing to Funtime 4 Pups that the Owner’s dog is/are in good health and have not harmed, shown aggression or exhibited any threatening behavior towards any person or other dog.
Owner further understands and agrees that neither Funtime 4 Pups nor any of its employees, staff or volunteers will be liable for any illness, injury, death and/or escape of Owner’s dog, provided that reasonable care and precautions are followed. Owner hereby releases Funtime 4 Pups employees, staff and/or persons of any liability of any kind whatsoever arising from or as a result of owner’s dog attending or participating in Park Playtime Trips. If Dog becomes ill, or if the state of the Dog's health otherwise requires professional attention, every reasonable attempt will be made to contact the Owner to direct care. However, if Owner is unreachable, Funtime 4 Pups at its sole discretion, may provide veterinary care or engage the services of a Veterinarian of Funtime 4 Pups’s choice, which may include after-hours care, with Owner being responsible for all associated fees and costs such as but not limited to medical treatment and transportation (as due).
I agree that I will disclose to Funtime 4 Pups any allergies my dog may have. I further agree to disclose to Funtime 4 Pups any special dietary needs or medications my dog may require if necessary during activities at Funtime 4 Pups.
Owner further understands and agrees that Owner’s dog is healthy and will at all times while attending Park Playtime Trips have current vaccinations. Owner is not enrolling any dog in Park Playtime Trips that has any condition that could potentially jeopardize the health of other dogs or people nor has/had any potentially communicable condition within the last 30 days prior to enrollment. Owner further understands that even if Owner(s) dog is vaccinated for Bordetella there is a chance that the Owner(s) dog can still contract upper respiratory disease complex and/or bordetella. Owner agrees that they will not hold Funtime 4 Pups responsible if Owner’s dog(s) contracts upper respiratory disease complex and/or Bordetella.
All dogs must be flea/tick/mite free. Should a dog be observed to have fleas/ticks/mites, the Owner is responsible and agrees to pick up the dog immediately. Funtime 4 Pups will not admit the dog back to Park Playtime Trips until there is proof of verification that flea/tick/mite treatment was applied and that all flea/ticks/mites are gone. Owner further understands that the Owner(s) dog can contract fleas/ticks/mites when interacting with other dogs and outside. Owner is responsible for preventative vet care including fleas/ticks/mites monthly preventatives. Owner agrees that they will not hold Funtime 4 Pups responsible if Owner’s dog(s) contracts fleas/ticks/mites.
Should Funtime 4 Pups, or anyone acting on their behalf, be required for any reason to incur attorney fees and costs to enforce or defend this agreement, I agree to indemnify and reimburse Funtime 4 Pups for such fees and costs. Further, I agree and understand that any disputes arising out of this Agreement will be decided pursuant to the laws of the State of Pennsylvania and venue shall be in Philadelphia County.
Funtime 4 Pups reserves the right to refuse admittance to any dog or to dismiss any dog that does not meet the health, temperament or other Park Playtime Trips standards. The determinations shall be made at the sole discretion of Funtime 4 Pups.

PHOTO AND VIDEO RELEASE: Funtime 4 Pups reserves to right to post pictures and videos of the Owner's dog(s) on social media, our website, and/or in ads. Owner agrees to allow Funtime 4 Pups to use Owner’s dog’s name and any images or likeness of Owner’s dog(s) taken while he/she is at Funtime 4 Pups, in any form, for use at any time, in any media, marketing, advertising, illustration, trade or promotional materials without compensation, and Owner releases to Funtime 4 Pups all rights that Owner may possess or claim to such image, likeness, recording, etc.

PICKUP/DROP-OFF: Owner agrees that pickup and drop-off transportation services is included within Park Playtime Trips and thus every term and condition written within this waiver and release of liability form extends to cover the full duration of pickup and drop-off transportation services too. Owner understands and agrees that exact pickup-drop off times cannot be guaranteed to stay within the 20 minute suggested buffer window before/after each appointment time due to a variety of natural factors including but not limited to: traffic, delays, and unforeseen incidents. Owner agrees that they will not hold Funtime 4 Pups responsible for injuries or harms or costs sustained by the Owner's dog(s) due to emergency incidents such as car accidents.

FULL FORCE AND EFFECT: Owner further understands and expressly agrees that each and every of the foregoing provisions contained in paragraphs 1-18 shall be in force and effect and shall apply to each and every occasion on which Owner’s dog(s) is with Funtime 4 Pups for any services, as the case may be. This Agreement shall remain in full force and effect as between the parties until and unless otherwise cancelled or superseded by a writing signed by the parties. Owner acknowledges that if their dog(s) is hurt, Owner is hurt, or property is damaged during their dog’s participation activities at Funtime 4 Pups, Owner may be found, by a court of law, to have waived their right to maintain a lawsuit against Funtime 4 Pups on the basis of any claim from which they have released them herein. Owner have had sufficient opportunity to read and fully understand this entire document and Owner agrees to be legally bound by its terms.
